Personal Data Privacy Policy
This Personal Data Privacy Policy (hereinafter – Privacy Policy) is a public Agreement concluded between the owner of the online store, Individual Entrepreneur “STEMSHOP” (the Seller) and the Buyer pursuant to Article 387 of the Civil Code of the Republic of Kazakhstan. It is based on the Law of the Republic of Kazakhstan “On Personal Data and Their Protection” and applies to information containing Buyers’ personal data that the online store https://www.stemshop.kz (hereinafter – Online Store) may obtain about Buyers while they use the Online Store website.
1 Definitions
1.1 Personal data – information relating to an identified or identifiable subject of personal data, recorded on electronic, paper or other material media.
1.2 Non-personal data – information automatically transmitted while the Buyer views advertising blocks and visits pages containing a statistics script: the address of the requested page, cookie information, IP address, browser information, referrer (previous page address), access time.
1.3 Collection of personal data – actions aimed at obtaining personal data.
1.4 Processing of personal data – actions aimed at accumulation, storage, modification, supplementation, use, dissemination, depersonalisation, blocking and destruction of personal data.
1.5 Protection of personal data – a set of legal, organisational and technical measures carried out for the purposes established by the Law of the Republic of Kazakhstan “On Personal Data and Their Protection”.
1.6 Online Store – the website located on a server in Almaty at https://www.stemshop.kz, where goods are presented for Buyers to place Orders, as well as the terms of payment and delivery of these Orders to Buyers.
1.7 Online-site Services – all services available for use on https://www.stemshop.kz and its sub-domains.
1.8 Buyer – a user of the Online Store.
1.9 Seller – Individual Entrepreneur “STEMSHOP”, owner of the Online Store, BIN 911024351583.
1.10 Cookies are small text files in which the browser records data from sites visited by Buyers. Cookies perform many functions: they let the Buyer move efficiently between pages, remember preferences and thus improve website interaction. They can also help ensure that the online advertising the Buyer sees matches his interests. Without cookies it would be impossible to buy goods in the Online Store, because the cart relies entirely on these files. For example, if the Buyer selects an item, puts it in the cart and goes to a new page, that item will not remain in the cart unless cookies are used.
1.11 IP address is a unique network address of a node in a computer network built on the IP protocol that allows determination of the Buyer’s location. The Online Store does not track location more precisely than city and region.
2 Subject of the Privacy Policy
2.1 This Privacy Policy sets the Seller’s obligations not to disclose and to ensure the confidentiality regime of personal data that the Buyer provides at the Seller’s request when registering on the Online Store website and/or when placing an order to purchase goods.
2.2 Personal data permitted for processing under this Privacy Policy are provided by the Buyer by filling out the registration form on the Online Store website and include the following information:
2.2.1 Buyer’s surname, first name, patronymic (patronymic optional);
2.2.2 Buyer’s contact phone number;
2.2.3 e-mail address;
2.2.4 goods delivery address.
2.3 Any other personal information not specified above (purchase history, browsers and operating systems used, etc.) is also subject to secure storage and non-disclosure, except as provided in Clauses 4.3.2 and 4.4 of this Privacy Policy.
3 Purposes of Collecting and Processing Buyers’ Personal Data
3.1 The Seller collects, processes and stores only those personal data necessary to provide Services and/or for the Buyer to purchase Goods from the Online Store catalogue.
3.2 The Seller uses the Buyer’s personal data for the following purposes:
3.2.1 identifying the Buyer to place an order and/or conclude a sales contract;
3.2.2 processing and receiving payments from the Buyer;
3.2.3 delivering goods to the Buyer;
3.2.4 providing effective customer support to the Buyer;
3.2.5 providing the Buyer with personalised Services;
3.2.6 communicating with the Buyer, including sending notifications, requests and information regarding Services, provision of services, as well as processing requests and applications from the Buyer;
3.2.7 improving the quality and usability of Services, developing new Services and offers;
3.2.8 informing the Buyer about events and promotions;
3.2.9 conducting statistical and other studies based on non-personal data, as well as optimising advertising messages.
3.3 The Seller is not responsible for information provided by the Buyer on the website in public form.
3.4 The Seller is not liable for losses the Buyer may incur if his login and password become known to a third party.
4 Rights and Obligations of the Parties
4.1 The Buyer shall:
4.1.1 provide personal data necessary for using the Online Store;
4.1.2 update or supplement the provided information if errors are detected while using the Online Store.
4.2 The Buyer has the right:
4.2.1 to access and edit his personal data at any time through the web interface provided by the Services.
4.3 The Seller shall:
4.3.1 use the received information solely for the purposes specified in Section 3 of this Privacy Policy;
4.3.2 keep confidential information secret, not disclose personal data transferred without the Buyer’s prior written consent, except for data transfer to fulfil the Buyer’s order (courier services, postal organisations, banks, etc.) and to authorised state bodies of the Republic of Kazakhstan in accordance with the legislation;
4.3.3 take precautions to protect the confidentiality of the Buyer’s personal data in accordance with procedures normally used to protect such information.
4.4 The Seller has the right to grant third parties access to collect and analyse Buyers’ non-personal data for statistical purposes and advertising optimisation. Use of non-personal data by third parties is governed by their own privacy policies, and the Online Store is not responsible for their use.
5 Other Conditions
5.1 Using the Online Store by the Buyer means his unconditional consent to this Privacy Policy and the conditions for processing his personal data by the Seller.
5.2 If the Buyer disagrees with the terms of the Privacy Policy, he must stop using the Site and the Online Store.
5.3 This Privacy Policy applies only to the Online Store website https://www.stemshop.kz and its sub-domains. The Online Store is not responsible for third-party sites to which the Buyer may navigate via links available on the Online Store website.
5.4 Due to the method of information acquisition, the Seller does not verify the accuracy of personal data provided by the Buyer and does not control their relevance. The Seller assumes that the Buyer provides accurate personal data and keeps them up to date. The Buyer bears full responsibility and possible consequences for providing false or outdated personal data.
5.5 Disabling cookies may make it impossible to access parts of the Online Store site that require authorisation.
5.6 The Online Store collects statistics on Buyers’ IP addresses. This information is used to detect and solve technical problems and to monitor the legality of financial payments.
5.7 The current legislation of the Republic of Kazakhstan applies to this Privacy Policy and the relations between the Buyer and the Seller.
5.8 The Seller reserves the right to unilaterally change this Privacy Policy to further improve the security system in accordance with the current legislation of the Republic of Kazakhstan.

5.10 The Seller is not responsible for the actions of third parties who, as a result of using the Internet, gained access to information about the Buyer, nor for the consequences of using information that is available to any Internet user.
